Article 1 (Scope)
These Rental Terms and Conditions govern the rental of TukTuk vehicles (hereinafter referred to as the “Service”) provided by our company. The renter agrees to use the Service in accordance with these Terms.
Article 2 (Formation of Rental Agreement)
- The rental agreement shall be concluded when the renter submits a reservation request using our prescribed method and we approve such request.
- Even after confirmation, we may refuse to provide the rental if any circumstances specified in these Terms apply.
Article 3 (Permitted Area of Use)
The TukTuk may only be used within Okinawa Prefecture. However, prohibited areas specified in these Terms are excluded.
Article 4 (Permitted Use)
- The vehicle may be used for private purposes as well as commercial purposes, including advertising, promotional activities, social media posts, video production, television, magazines, and online distribution.
- However, if the content of filming or the manner of use violates laws or public order, or may pose a risk to the vehicle or third parties, we reserve the right to restrict or terminate such use.
Article 5 (Refusal of Rental)
We may refuse or cancel the rental in any of the following cases:
- The renter does not possess a valid driver’s license.
- The renter is deemed unlikely to comply with these Terms or applicable laws.
- The renter is suspected of being under the influence of alcohol or drugs.
- Weather conditions, natural disasters, or other safety concerns make the rental unsafe in our judgment.
Article 6 (Reservation Cancellation)
- If the renter cancels a reservation, cancellation fees shall apply in accordance with our separate Cancellation Policy.
- The details of the Cancellation Policy shall be provided on our website or by other appropriate means.
Article 7 (Suspension Due to Storm Warning, etc.)
- If a storm warning is issued by the Japan Meteorological Agency before or during the rental period, we may suspend all or part of the Service for safety reasons.
- In such cases, any unused rental fees shall be fully refunded.
Article 8 (Duty of Care During Use)
The renter shall use the TukTuk with due care as a prudent operator and comply with the Road Traffic Act of Japan and all other applicable laws and regulations.
Article 9 (Prohibited Areas and Acts)
The renter shall not engage in any of the following:
- Driving on expressways or motorways (including roads designated for motor vehicles only)
- Unauthorized modifications or removal of vehicle parts
- Reckless driving or racing
- Subleasing or transferring the vehicle to a third party
- Any other act deemed unsafe or inappropriate by the company
Article 10 (Accident or Breakdown)
In the event of an accident, theft, breakdown, or any abnormal condition, the renter must immediately stop driving and contact the company.
Article 11 (Liability for Damages)
If damage is caused to the company or a third party due to reasons attributable to the renter, the renter shall be fully liable for such damages.
Article 12 (Disclaimer)
The company shall not be liable for damages arising from natural disasters, changes in laws, traffic restrictions, or any other circumstances beyond our control.
Article 13 (Amendment of Terms)
We reserve the right to amend these Terms as necessary. Any revisions shall be announced on our website or by other appropriate means.
Article 14 (Governing Law and Jurisdiction)
These Terms shall be governed by the laws of Japan. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over our company’s principal place of business as the court of first instance.
